前總統陳水扁的兒子陳致中，在2010年高市議員選舉前退出民進黨，不過陳致中已於今年9月28日，民進黨黨慶日時申請恢復黨籍，但根據民進黨黨章規定，凡是退黨參選者「視同除名處分」，需滿5年才能重新入黨，因此陳致中能否恢復黨籍，恐怕還充滿變數。
陳致中是在2010年6月11日，宣布退出民進黨，以無黨籍身份參選前鎮區、小港區的高雄市議會議員選舉。這回是在民進黨高雄市黨部主委王聖仁的“推薦”下，向民進黨高雄市黨部提交申請“民進黨籍恢復案”。
但尷尬的是，根據民進黨公職人員提名條例第九條規定，凡是退黨參選者「視同除名處分」，5年內不得申請入黨，也就是說陳致中必須在2015年才能重新申請入黨。
民進黨發言人王閔生表示，根據黨部黨員電腦資料顯示，2010年6月，陳致中於2010年6月退黨參選直轄市議員，與他狀況相同的當時共有11人。退黨參選者視同除名處分，黨部從無例外過。
對於高雄市黨部一頭熱，力薦陳致中重新入黨，黨內人士表示，屆時申請案還是會被黨中央「駁回」處理。
